The Auckland Landscape Company Limited ("TALC", "we", "us", "our") operates aucklandlandscaping.co.nz (the "Site") and provides residential landscape design and construction services in Auckland. This Privacy Policy explains how we collect, use, store, share and protect your personal information, and the rights you have under the Privacy Act 2020 (NZ).

By using our Site, submitting an enquiry, booking a consultation, or engaging us for services, you agree to the practices described in this Policy.


1. Information we collect

We only collect information that we genuinely need to operate our business, respond to your enquiries, deliver projects, and improve our services. The categories include:

Information you give us directly:

  • Name and contact details (email, phone number, postal/site address, suburb)
  • Project information (property type, project goals, budget range, timeframes, site details, photos you choose to share)
  • Communications you send us (emails, form submissions, SMS, call recordings if applicable, messages via social channels)
  • Payment and billing details if you engage us for services (processed via our accounting and invoicing systems)

Information we collect automatically when you visit the Site:

  • Device and browser information (IP address, browser type and version, operating system, device identifiers)
  • Usage information (pages visited, time on page, scroll depth, links clicked, referring website, search terms, date and time of visit)
  • Approximate location derived from your IP address
  • Information collected via cookies and similar tracking technologies (see Section 7)

Information from third parties:

  • Reviews and testimonials you publish on platforms such as Google, Builderscrack, or Neighbourly
  • Information from advertising platforms (Meta, Google) about how you interacted with our ads
  • Referrals or introductions from existing clients, suppliers or partners

We do not knowingly collect more information than we need.


2. How we use your information

We use your personal information to:

  • Respond to enquiries and book consultations
  • Prepare scopes, estimates, designs, and quotes
  • Deliver landscape design, construction, and aftercare services
  • Communicate with you about your project (updates, scheduling, variations, invoicing)
  • Send marketing communications where you have opted in or where we have a lawful basis (you can unsubscribe at any time — see Section 6)
  • Improve our website, services, and customer experience
  • Measure the performance of our advertising campaigns
  • Operate retargeting and lookalike advertising on platforms such as Meta and Google
  • Comply with legal, tax, accounting, and health & safety obligations
  • Detect, prevent, and address fraud, security issues, or misuse of the Site

3. Who we share your information with

We do not sell your personal information. We share it only with parties who help us operate our business, and only to the extent necessary. These include:

We require all third-party providers to handle your information securely and only for the purposes we engage them for.


4. Overseas storage and transfer of information (IPP 12)

Some of the providers listed above store and process information outside New Zealand, including in the United States, European Union, Australia, and other jurisdictions where the provider operates its servers (this includes Google, Meta, and most major cloud services).

Under Information Privacy Principle 12 of the Privacy Act 2020, we only disclose your personal information overseas where:

  • The recipient is subject to comparable privacy safeguards (e.g. through the EU GDPR, US data protection frameworks, or contractual safeguards), or
  • You have authorised the disclosure after being told that your information may not be protected to the same standard as in New Zealand.

By submitting information through our Site or using our services, you acknowledge that your information may be transferred overseas on this basis.


5. How we store and protect your information

We take reasonable steps to protect your personal information from loss, misuse, unauthorised access, modification or disclosure. These include:

  • Hosting on reputable infrastructure providers with industry-standard security
  • HTTPS encryption across the Site
  • Access controls, password protection, and limited internal access
  • Staff and contractor confidentiality obligations
  • Regular software updates and security patching

No system is completely secure. If we become aware of a notifiable privacy breach (a breach that has caused or is likely to cause serious harm), we will notify the Office of the Privacy Commissioner and affected individuals as required by the Privacy Act 2020.


6. How long we keep your information

We retain personal information only for as long as we need it for the purposes set out in this Policy, or as required by law:

  • Enquiry data (unconverted leads): typically up to 24 months from last contact, then deleted or anonymised
  • Client project records, contracts, and communications: at least 7 years from project completion (to meet tax, warranty, and legal obligations)
  • Financial and tax records: 7 years (Inland Revenue requirements)
  • Marketing consent records: for as long as you remain subscribed, plus a reasonable period afterwards to evidence consent

You can ask us to delete your information at any time (see Section 9), subject to our legal obligations to retain certain records.


7. Cookies and tracking technologies

The Site uses cookies and similar technologies to operate properly, measure performance, and deliver advertising. The main categories are:

  • Essential cookies — required for the Site to function (e.g. session management, security)
  • Analytics cookies — Google Analytics 4 via Google Tag Manager, used to understand how visitors use the Site
  • Advertising and retargeting cookies — Meta Pixel and Google Ads tags, used to measure ad performance and show you relevant ads on Facebook, Instagram, and across the Google network

8. Marketing communications

If you have opted in to marketing communications, or if we are sending you information related to a service you have engaged us for, we may contact you by email, SMS, or phone in line with the Unsolicited Electronic Messages Act 2007.

Every marketing email and SMS we send includes an unsubscribe option. You can also opt out at any time by emailing admin@aucklandlandscaping.co.nz. Opting out of marketing does not stop us sending you operational messages relating to a project or service we are delivering for you.


9. Your rights under the Privacy Act 2020

You have the right to:

  • Access the personal information we hold about you (IPP 6)
  • Correct information that is inaccurate, incomplete, or out of date (IPP 7)
  • Withdraw consent for marketing communications at any time
  • Request deletion of your information, subject to our legal retention obligations
  • Complain to us, or to the Office of the Privacy Commissioner, if you believe we have breached your privacy

To exercise any of these rights, contact our Privacy Officer (Section 10). We will respond within 20 working days as required by the Act. There is generally no charge for a request, although we may charge a reasonable fee in limited circumstances permitted by the Act.

Our services are directed at adult homeowners. We do not knowingly collect personal information from anyone under the age of 18. If you believe a child has provided us with personal information, please contact our Privacy Officer and we will take steps to remove it.


13. Links to other websites

Our Site may link to third-party websites. We are not responsible for the privacy practices or content of those sites. We recommend you review the privacy policy of any third-party site you visit.


14. Changes to this Policy

We may update this Privacy Policy from time to time. The current version will always be available at aucklandlandscaping.co.nz/privacy-policy/, and the effective date at the top will reflect the most recent update. Where changes are significant, we will take reasonable steps to notify you (for example, via email if we hold your address, or a notice on the Site).


This Privacy Policy is governed by the laws of New Zealand.
